THE CHEERIOS EFFECT CAMPAIGN
TERMS AND CONDITIONS OF PARTICIPATION

  1. Campaign and Campaign Period

    General Mills Canada Corporation (“General Mills”) is the sponsor of “The Cheerios Effect” Campaign (the "Campaign"). The Campaign opens September 28th 2014 and closes May 31st 2015. No purchase is necessary to participate in the Campaign.

    The Campaign is open for participation to residents of Canada of the age of majority in their province or territory of residence (“Participants”).

    The Campaign celebrates connections and building a more connected world. As a way to inspire a more connected world, Participants are invited to make a written submission that tells a story about a special connection that they have (the “Submission”). The Submission will then be used to create a personalized mini-video, which General Mills may post to www.cheerioseffect.ca or www.leffetcheerios.ca (collectively, the "Website.")

  2. How to Make a Submission

    To make a Submission, visit the Website and complete the steps. Only one Submission may be made at a time.

  3. Submission Requirements

    A Submission must comply with these Terms and Conditions of Participation.

    A Submission must:

    • Be no more than 300 words in length.
    • Not contain any content that is lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, or that otherwise contains inappropriate content or objectionable material as determined by General Mills in its sole and absolute discretion.
    • Be the Submitter's original work, created solely by the Submitter, and must not infringe the copyright, trademark, privacy, publicity, or other intellectual rights of any person or entity.
    • Not contain any materials or elements that are not owned by the Submitter and/or which are subject to the rights of any third parties.
    • Not contain any commercial content.
    • Not contain any personally identifiable information of any person. Should the Submitter include personally identifiable information about himself/herself, then Submitter acknowledges and agrees that such information may be disclosed publicly and the Submitter is solely responsible for any consequences thereof.
  4. Grant of License for the Submission.

    The Participant hereby grants to General Mills a non-exclusive, transferable, royalty-free, worldwide license to use, edit, adapt and publish the Submission, in connection with the Campaign/Campaign related purposes (including without limitation the Website) and/or any other commercial or other purposes, and in any and all media, including without limitation advertising and packaging for General Mills products, now known or hereafter known throughout the world in perpetuity, without attribution, compensation, permission or further notification to the Submitter, his/her successors or assigns, or any other entity, unless prohibited by law.

  5. Participant’s Consent.

    The Participant consents to the use of the Submission for any publicity or programming purposes, in all media, on all packaging and display, without remuneration, throughout the world in perpetuity.

  6. Participant’s Acknowledgements.

    The Participant confirms he/she is of the age of majority in his/her province of residence.

    The Participant agrees he/she is responsible for obtaining and has obtained, prior to sending the Submission, any and all releases and consents necessary to permit the exhibition and use of the Submission as set forth in these Terms and Conditions of Participation.

    The Participant represents and agrees he/she is not (i) represented under contract (e.g., by a talent agent or manager) that would limit or impair General Mills' ability to display the Submission in any media form; (ii) under any contract that would make the Submission a violation of any third party rights; or (iii) under any other contractual relationship, including but not limited to guild and/or union memberships, that may prohibit him/her from allowing General Mills to use the Submission on a royalty-free basis, worldwide, in all media and in perpetuity.

    The Participant agrees the Submission conforms to these Terms and Conditions of Participation. The Participant agrees General Mills, in its sole and absolute discretion, may disqualify the Submission for any reason at any time, including if it determines, in its sole and absolute discretion, that the Submission fails to conform to these Terms and Conditions of Participation in any way or otherwise contains unacceptable content.

  7. General Conditions.

    General Mills and its subsidiaries, affiliates, agencies and contractors, and their respective officers, directors and employees (collectively, the “Released Parties”), are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, or garbled stay data, emails, online or mailed entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind relating to or in connection with the Campaign. Released Parties are also not responsible for (i) any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Campaign; and/or (ii) injury or damage to participants' or to any other person's computer related to or resulting from participating in this Campaign or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Campaign or website or who are in violation of these Terms and Conditions of Participation, as solely determined by General Mills, will be disqualified and all associated entries will be void. General Mills reserves the right at its sole discretion to suspend, modify or terminate the Campaign should any portion of the Campaign be, in General Mills' sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the General Mills, corrupt or impair the administration, security, fairness or proper play, or submission of entries.

  8. Governing Law/Jurisdiction.

    All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions of Participation or the rights and obligations of participants or General Mills in connection with the Campaign shall be governed by and construed in accordance with the laws of the province of Ontario, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state laws. Claims may not be resolved through any form of class action. Venue for all suits will be in the province of Ontario

  9. Severability.

    If any provision(s) of these Terms and Conditions of Participation are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

  10. Sponsor.

    The Campaign is not in any way sponsored, endorsed or administered by, or associated with, Facebook or Twitter.
